Terms of Service

1. About Mayura Arts

These Terms of Service govern your use of the Mayura Arts platform (mayuraarts.nl) and your enrolment in courses offered by Mayura Arts. By creating an account or enrolling in a course, you agree to these terms.

You must be 18 years of age or older to register an account and enrol on this platform. For a student under 18, a parent or legal guardian must register the account, accept these terms, and remain the contracting party for any enrolment on behalf of the student. Invoices are issued in the name of the registering guardian, who is the legal payer.

2. Enrolments

Mayura Arts offers three types of enrolment:

  • Open-ended lessons — weekly lessons with no fixed end date. You are assigned a recurring weekly time slot and are invoiced monthly for the sessions you attended, plus any sessions cancelled with less than 5 calendar days notice (see Section 4). Sessions cancelled by Mayura Arts are not billed and no make-up session is offered. You may stop attending at any time, subject to the notice rule in Section 4.
  • Fixed-term courses — weekly lessons that run from a defined start date to a defined end date. Enrolment is a commitment to the full course. Fees are charged in monthly instalments for the duration of the course, regardless of individual attendance.
  • Workshops — one-off sessions paid for in a single upfront payment.

Mayura Arts reserves the right to cancel or reschedule a fixed-term course or workshop. In that case, a full refund or alternative placement will be offered for the cancelled sessions.

Enrolment of students under 18 years of age must be completed by a parent or legal guardian, who becomes the contracting party (see Section 1).

3. Fees & Payment

  • All fees on this platform are stated and payable in euros (EUR).
  • Students under 21 years of age: tuition for our visual-arts (beeldende vorming) courses is exempt from BTW (VAT), in line with the Dutch BTW exemption for arts education to persons under 21, as published by the Belastingdienst. No BTW is added to these fees. Age is assessed at the start of the course; a student who turns 21 during the course remains exempt for the remainder of that course.
  • Students aged 21 and over: tuition is subject to the standard Dutch BTW rate of 21%, which is added to the listed fees.
  • Invoices are due within 14 days of the payment request.
  • Failure to pay by the due date may result in suspension of the enrolment until payment is received. Where a payment is overdue, you will first receive a reminder allowing at least 14 days to pay before any collection costs are applied.

4. Cancellations & Refunds

Cooling-off (all enrolment types). Under Dutch consumer law (Art. 6:230o BW), you have 14 days from confirming your enrolment to withdraw without giving reasons and receive a full refund. Mayura Arts will not begin lessons or workshops until this 14-day period has elapsed, so no pro-rata deduction applies.

Open-ended lessons

  • Your weekly time slot is reserved for you. If you are unable to attend a scheduled session, please notify us at least 5 calendar days in advance — either by email to info@mayuraarts.nl or via the same WhatsApp chat we use to coordinate your classes.
  • Sessions cancelled with less than 5 calendar days notice will be billed as a no-show.
  • To end your enrolment altogether and release your slot, please give us at least 5 calendar days notice by email or WhatsApp.

Fixed-term courses

  • Enrolling in a fixed-term course is a commitment to the full course. Individual missed sessions are not refunded or transferred.
  • After the 14-day cooling-off period, course fees already paid are non-refundable, and any remaining monthly instalments for the duration of the course remain payable, unless Mayura Arts cancels the course.

Workshops

  • After the 14-day cooling-off period, the workshop fee is non-refundable unless Mayura Arts cancels the workshop.

5. Conduct

All participants are expected to behave respectfully towards teachers and other students. Mayura Arts reserves the right to exclude any student whose conduct is disruptive or harmful to the learning environment. In the event of exclusion due to conduct, fees already paid will not be refunded.

6. Liability

Participation in Mayura Arts courses is at the student's own risk. Mayura Arts is not liable for personal injury, loss, or damage arising from participation, except where such loss or damage results from our gross negligence or wilful misconduct.

Where Mayura Arts is liable, its total liability towards the student is limited to the amount actually paid by the student for the enrolment under which the incident occurred: for a fixed-term course or workshop, the fee paid for that course or workshop; for open-ended lessons, the lesson fees paid in the twelve months preceding the incident.

Force majeure. If circumstances beyond our reasonable control (such as teacher illness, loss of the rented venue, government restrictions, or similar events) prevent a scheduled session from going ahead, we will first attempt to reschedule the session within the course. If rescheduling is not reasonably possible, the affected sessions will be refunded pro-rata.

7. Personal Data

We take your privacy seriously. How we collect, use, and protect your personal data is described in our Privacy Policy. By creating an account, you acknowledge that you have read and understood that policy.

8. Governing Law

These terms are governed by Dutch law. Before resorting to court proceedings, the parties will first make a good-faith attempt to resolve any dispute through informal discussion or mediation. Any disputes that cannot be resolved amicably shall be submitted to the competent court in the Netherlands.

9. Changes to These Terms

We may update these terms when our services change. The date at the top of this page reflects the most recent revision. For material changes, we will notify registered users by email at least 30 days before the change takes effect. If a change is materially unfavourable to you, you may terminate your enrolment without penalty by giving us written notice (by email or WhatsApp) before the change takes effect.
